A tort is a breach of duty from one person (or business) to another for which the law may provide a remedy. There are many different kinds of torts of both a personal and business nature, including battery, car wrecks, personal injury, defamation, negligence, etc. Basic negligence requires a showing of four things: (1) that the person owed you a duty of care; (2) that the person breached that duty; (3) that the breach was the legal cause of harm; (4) harm. Often in our society people and businesses may breach duties, but they breach doesn't result in harm; other times victims may not fully understand or quantify the harm they have incurred. Further, people and business often have insurance covering breaches in duty.
